Im the first pedestrian to get hit by drunk driver and its my fault

My personal injury lawsuit (for a spinal fusion surgery) took 4 years until a settlement agreement was reached. Once the agreement was reached, I received a check about 2 weeks later, less the attorney fees and some bills.

Police won't do anything in this case. Next. Also, everyone says their back and neck hurts.

Basically we were at red light.its turned green I let the brake go and the car suddenly stopped.probly 1mph and barely bumped into the.took a picture only a scratch on car.no police came nor ambulance.they said we can just get it fixed and not involve insurance.they lied as they filed a claim.my insurance paid them each 18k and they cashed but never signed the release as my insurance told them to sign or send check back.they cashed it and now 1 week before there 2 year limitation was over they are sueing me for more.is this my insurance fault I have 25k/50k.they didn't pay my full limits and now I'm being sued.wat are my chances as they sent a new bill saying they got more treatment and want property damages too.is this a bad faith against my insurance if so are they liable for anything axcessive over my policy limits?

Great info thanks. A driver merged into my lane and caused a collision. His insurance denied claim due to Contributory Negligence in VA. Even though I was riding my brakes the whole time but didn't slam on my brakes. I have an officer who watched CCTV and wrote me an email saying it was the other drivers fault. I have video where the other driver says it's his fault but with a thick accent. I have photos where my car is nearly parallel to the curb and other driver is halfway in my lane. I have no idea what other evidence I need to plead my case. My insurance took it to Insurance Arbitration. The outcome says I was partially at fault for not jamming my brakes. I asked for transcripts but have been ignored. In VA, if you're 1% at fault you get nothing. My hands are tied. Do I have any options to me? Oh, and also my rates went up and I'm in a database with an at fault collision. This is nuts. Thank you

I wonder if Law teams advocate with their client to utilize their health insurance especially if they have it given that's what it is for. My question stems from the thought that some of these plaintiffs maybe don't use the settlement they receive to pay the medical bills and keep the money and use their insurance "in secret" if you will, is there any truth to this?

Kelly Law Team ? ? can a citizen sue a street gang who cause injury ? who pays for that victim medical bills, pain and suffering, rent or Mortgage, lost of wages, credit card, utility bills, etc. ? Think of it like being in a car accident, that's cause by somebody else and you getting injured but except you getting jumped or shot by a street gang and end up in the same place as a car accident victim, "the hospital".

better yet, we can pass laws that all motor vehicles have an onboard video recording system. then we can put an end to all these b.s. lawsuits and our insurance rates will plummet. no more fraud no more high insurance rates. a win win for everybody right? I'm gonna go call my state senate rep and maybe start a ballot initiative to do that, only dishonest people would be against that right? all trucks have cameras on them now. Only has Liability insurance, offer I believe is too small but lawyer says he has no assets to sue in personal form. I'm stuck now in physical therapy after months of excruciating pain in leg. I just went to trial for a car accident. The insurance company was something else. Was rear ended I was waiting at a light and a truck trying to run a train hit me and my son. I've had nerve pain shooting down my arm. I was referred to a MRI and the company still said only 2k for my car and medical. In the end the jury awarded us the max amount and a dollar more. This took 4 yrs. They had no medical witnesses no previous medical history because I wasn't injured before. My attorney said he was hoping for 60k but anything over 2k was a win because that's all they were willing to pay. Ended up getting 5x the amount my lawyer was hoping we would get. Trial is definitely nerve wrecking.
